Welcome to The Assist (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of The Assist website, mobile applications, programs, and services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.
1. Nature of Services
The Assist provides educational services, mentorship programs, workshops, seminars, panel discussions, leadership development programming, and access to a private membership-based community for current and former athletes.
The Assist is:
An education and mentorship platform
Not a licensed counseling service
Not a medical or mental health provider
Not a financial advisor
Not a law firm
Not an employment agency or recruiter
All content, mentorship, and programming are provided for educational and informational purposes only.
2. Eligibility
To use the Platform, you must:
Be at least 18 years old; or
Be under 18 with verified parental or legal guardian consent
Provide accurate registration information
Comply with all applicable laws
We reserve the right to deny or terminate membership at our sole discretion.
3. Membership & Community Standards
The Assist is a curated, membership-based community. By joining, you agree to:
Engage respectfully with other members
Refrain from harassment, discrimination, or abusive conduct
Not post false, misleading, or defamatory content
Not use the Platform for unlawful activity
Maintain confidentiality of private community discussions
We reserve the right to remove content or terminate accounts that violate these standards.
No refunds are guaranteed unless explicitly stated in a separate written agreement.
4. No Professional Advice
The Assist provides mentorship and educational programming only.
Nothing on the Platform constitutes:
Medical advice
Mental health counseling
Legal advice
Financial advice
Employment guarantees
You acknowledge that any decisions you make based on Platform content or mentorship are your sole responsibility.
If you are experiencing a mental health crisis, contact a licensed professional or emergency services immediately.
5. Mentorship & Playmaker Disclaimer
Playmakers are independent individuals who participate in mentorship and educational programming. They are not employees, agents, or representatives authorized to bind The Assist legally.
The Assist:
Does not guarantee mentorship placement
Does not guarantee outcomes
Does not guarantee introductions or professional opportunities
Is not responsible for statements made by Playmakers
All mentorship participation is voluntary.
6. Job Board & Career Opportunities Disclaimer
The Assist may provide access to job listings or networking opportunities.
We do not:
Guarantee employment
Screen every employer
Guarantee accuracy of listings
Act as an employment agency
All employment decisions and interactions are solely between users and third parties.
7. User Content & License
You retain ownership of the content you post (“User Content”). However, by posting on the Platform, you grant The Assist a non-exclusive, royalty-free, worldwide license to:
Display
Reproduce
Distribute
Promote
your content within the Platform and in marketing materials.
You represent that:
You own the rights to your content
Your content does not infringe on third-party rights
We may remove content at our discretion.
8. Intellectual Property
All Platform materials, including but not limited to:
Logos
Branding
Program materials
Educational content
Videos
Written materials
are the exclusive property of The Assist and may not be copied, reproduced, or distributed without written permission.
9. Assumption of Risk
Participation in workshops, discussions, mentorship programs, live events, or community engagement involves inherent risks, including but not limited to:
Emotional discomfort
Professional disappointment
Miscommunication
You voluntarily assume all risks associated with participation.
10. Limitation of Liability
To the fullest extent permitted by law, The Assist shall not be liable for:
Indirect, incidental, or consequential damages
Loss of income or employment opportunities
Emotional distress
Personal decisions made based on mentorship
Third-party actions
Our total liability shall not exceed the amount paid by you (if any) in the preceding 12 months.
11. Indemnification
You agree to indemnify and hold harmless The Assist, its owners, officers, directors, contractors, and affiliates from any claims arising out of:
Your use of the Platform
Your violation of these Terms
Your content
Your interactions with other members
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use personal data.
13. Termination
We may suspend or terminate your access to the Platform at any time for:
Violation of these Terms
Conduct harmful to the community
Legal compliance reasons
Termination does not relieve you of obligations incurred prior to termination.
14. Modifications
We may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts located in San Diego County, California.
16. Arbitration Clause (Recommended for Protection)
At our discretion, we may require disputes to be resolved through binding arbitration rather than court litigation, except for intellectual property claims.
Users waive the right to participate in class action lawsuits.
